Welcome to Yugen Surf. These Terms and Conditions ("Terms") govern your use of our website located at yugen.surf (the "Site"), the creation of a user account, participation in our Progression Quiz, and the purchase of any products or services offered through the Site. By accessing the Site, creating an account, completing the Progression Quiz, or purchasing a product or service, you agree to be bound by these Terms. If you do not agree, please do not use the Site.

1. About Us

Yugen Surfboards (ABN 47 817 821 526), trading as Yugen Surf ("we," "us," or "our"), is a sole trader business based on the Northern Beaches of Sydney, NSW, Australia. We provide surf coaching services, surf skate coaching, remote video analysis, self-guided progression programs, and bespoke custom surfboards.

2. Eligibility

2.1. You must be at least 18 years of age to create an account, purchase products or services, or participate in coaching activities.

2.2. Participants aged under 18 may participate in coaching activities only with the written consent of a parent or legal guardian. The parent or guardian must complete and sign the Waiver and Release of Liability form on behalf of the minor before any session commences.

2.3. For in-water coaching, all participants (or their parent/guardian) must declare that the participant is able to swim a minimum of 200 metres unassisted in open water.

3. User Accounts

3.1. You may create an account on the Site to access certain features including booking, purchasing, and viewing your quiz results and progression plan.

3.2. You are responsible for maintaining the confidentiality of your login credentials and for all activity that occurs under your account.

3.3. We reserve the right to suspend or terminate accounts that we reasonably believe are being used fraudulently, in breach of these Terms, or for any unlawful purpose.

4. Progression Quiz

4.1. The Progression Quiz is a free tool designed to assess your current surf level and identify your primary limiter. It collects personal information including your name, email address, surfing experience, physical attributes, and self-assessed abilities.

4.2. Quiz results are generated by an automated scoring system and are indicative only. They do not constitute professional advice and should not be relied upon as a substitute for in-person assessment.

4.3. By completing the quiz and providing your email address, you consent to receiving your personalised results and being enrolled in our email program delivered via Klaviyo. You may unsubscribe at any time using the link in any email.

5. Coaching Services

5.1. Services Offered. We offer in-water surf coaching (private and group sessions), surf skate coaching, pool-based coaching, beach-based warm-ups, and remote video analysis. All coaching is delivered by or under the supervision of qualified coaches.

5.2. Booking and Payment. All coaching sessions and packages must be paid for at the time of booking. Payment is processed securely via Stripe. We do not store your credit card information.

5.3. Momentum Packs (Credit-Based Packages). Momentum Packs entitle you to a specified number of coaching session credits. Credits must be used within the following periods from the date of purchase:

• 8-session pack: 10 weeks
• 12-session pack: 14 weeks
• 24-session pack: 26 weeks

Credits not used within the applicable period will expire automatically and are non-refundable. It is your responsibility to schedule sessions within the validity period.

5.4. Cancellation by You. A minimum of 24 hours' notice is required to cancel or reschedule any coaching session (private, group, or surf skate). Cancellations made with more than 24 hours' notice will receive a full credit for a future session (or credit returned to your account for Momentum Pack bookings). Cancellations within 24 hours of the scheduled session are non-refundable and no credit will be returned.

5.5. Cancellation by Us — Weather and Conditions. Surfing is dependent on ocean and weather conditions. If we cancel a session due to unsafe or unsuitable conditions (including but not limited to dangerous surf, lightning, extreme weather, or hazardous water quality), you will receive a full credit to reschedule at a mutually agreeable time.

5.6. Waiver Requirement. All participants in any physical coaching activity (in-water, surf skate, pool, or beach-based) must read and sign our Waiver and Release of Liability before their first session. Participation is conditional upon completion of the waiver. For participants under 18, the waiver must be signed by a parent or legal guardian.

5.7. Fitness and Medical Disclosure. You are responsible for ensuring you are physically fit to participate. You must disclose any medical conditions, injuries, or medications that may affect your ability to safely participate. We reserve the right to refuse participation if we reasonably believe it poses a safety risk to you or others.

6. Remote Coaching

6.1. Remote video analysis is delivered asynchronously. You submit footage; we provide analysis and feedback via video or written report.

6.2. Remote coaching does not involve in-person instruction and does not require a waiver. However, you acknowledge that any exercises, techniques, or recommendations provided are general in nature and that you participate in any self-directed practice at your own risk.

6.3. Refunds for remote coaching are available at our discretion if the analysis has not yet been delivered, within 7 days of purchase.

7. Free 6-Week Progression Plan

7.1. Upon completing the Progression Quiz, you may receive a free 6-Week Progression Plan delivered via email. This is a self-guided educational program and is provided at no cost.

7.2. The program is general in nature and does not constitute personalised coaching advice. You participate in any suggested exercises or practice at your own risk.

7.3. By opting into this program, you consent to receiving the full email sequence. You may unsubscribe at any time.

8. Bespoke Surfboards

8.1. Design Session Deposit. A non-refundable deposit of $150.00 AUD is required to book a one-on-one Design Session. This deposit secures your consultation and will be credited toward the final price of your surfboard.

8.2. Deposit Cancellation. The $150.00 AUD deposit is fully refundable if you cancel your Design Session with more than 24 hours' notice. If you complete the Design Session but choose not to proceed with a board order, the deposit is retained as a non-refundable consultation fee.

8.3. Production and Payment. After your Design Session, a final invoice for the remaining balance will be issued. Production commences only after full payment. The typical production timeframe is 4–6 weeks from final payment, though this is an estimate and may vary.

8.4. Changes and Cancellations. Custom surfboards are made to your specifications. We do not offer refunds or accept returns for change of mind once production (shaping) has commenced. Minor modifications may be possible depending on production status, at our sole discretion.

8.5. Shipping. We offer shipping Australia-wide. International shipping may be arranged on request. All shipping costs are quoted and invoiced separately. Shipments are fully insured against damage during transit.

8.6. Manufacturing Warranty. We provide a 30-day warranty against manufacturing defects from the date of delivery or collection. This covers defects of craftsmanship such as delamination. It does not cover damage resulting from misuse, impact, heat exposure, improper storage, or normal wear and tear. To make a warranty claim, email info@yugen.surf with the subject line "Warranty Claim," including your original invoice and clear photographs of the defect. Determination of whether damage constitutes a manufacturing defect is at our reasonable discretion.

9. Refund Policy Summary

10. Australian Consumer Law

10.1. Nothing in these Terms excludes, restricts, or modifies any consumer guarantee, right, or remedy conferred on you by the Australian Consumer Law (Schedule 2 of the Competition and Consumer Act 2010 (Cth)) or any other applicable law that cannot be excluded, restricted, or modified by agreement.

10.2. For coaching and other recreational services, to the maximum extent permitted under section 139A of the Competition and Consumer Act 2010 (Cth) and section 5M of the Civil Liability Act 2002 (NSW), we exclude liability for death or personal injury arising from the supply of recreational services where you have been given and have agreed to a risk warning in the form required by law.

11. Limitation of Liability

11.1. To the maximum extent permitted by law and subject to clause 10, our total aggregate liability to you for all claims arising out of or in connection with these Terms, the Site, and our services shall not exceed the total amount paid by you to us in the 12 months preceding the claim.

11.2. We are not liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, or goodwill, however caused.

11.3. We are not liable for any injury, loss, or damage arising from your participation in self-directed activities (including but not limited to practicing techniques shown in the 6-Week Progression Plan, remote coaching recommendations, or any content published on the Site or via email).

12. Intellectual Property

12.1. All content on the Site — including text, graphics, logos, images, video, audio, quiz questions, scoring methodologies, and software — is the property of Yugen Surfboards (trading as Yugen Surf) or its licensors and is protected by Australian and international copyright law.

12.2. You may not reproduce, distribute, modify, or create derivative works from any content on the Site without our prior written consent.

13. Website Use

13.1. You agree not to use the Site for any unlawful purpose or in any way that could damage, disable, or impair the Site.

13.2. You must not attempt to gain unauthorised access to any part of the Site, user accounts, or our systems.

13.3. We reserve the right to refuse service to anyone for any reason at any time.

14. Dispute Resolution

14.1. If you have a complaint or dispute, please contact us at info@yugen.surf. We will endeavour to resolve your concern within 14 business days.

14.2. If a dispute cannot be resolved informally, the parties agree to attempt mediation before commencing any legal proceedings. Mediation shall be conducted in Sydney, NSW, in accordance with the mediation rules of the Resolution Institute.

14.3. These Terms are governed by the laws of New South Wales, Australia. The parties submit to the non-exclusive jurisdiction of the courts of New South Wales.

15. Changes to These Terms

15.1. We may update these Terms from time to time by posting the revised version on the Site with a new "Last Updated" date. Your continued use of the Site after any changes constitutes acceptance of the updated Terms.

15.2. For material changes that affect your existing rights or obligations (such as changes to refund policies or credit expiry periods), we will endeavour to provide reasonable notice via email.
